Negotiation is the process of reaching an agreement between parties who have both shared and conflicting interests. It happens constantly, in deals, in projects, in daily work, and treating it as a skill to be learned rather than a talent you either have or lack is what separates people who consistently reach good agreements from those who rely on luck or force.

The central shift in modern negotiation thinking is from bargaining over positions to focusing on interests. When people negotiate by staking out positions and grinding toward a compromise, they often reach a poor deal or none at all, because positions are rigid and adversarial. When they instead look for the underlying interests behind each position, they frequently find that a solution exists which serves both sides better than either's opening position, turning a contest into a shared problem to be solved.

This framework describes negotiation as a learnable discipline based on principled negotiation, from preparing well to focusing on interests to knowing your alternatives. It draws on the recognized negotiation research of the Harvard Negotiation Project and is written to be reusable in any negotiation, without reproducing its text.

Note: Negotiation is a skill, not a personality trait. The people who consistently reach good agreements are usually the ones who prepared best and focused on interests, not the loudest or the most aggressive.

التفاوض عملية بلوغ اتفاقٍ بين أطرافٍ لهم مصالح مشتركة ومتعارضة معًا. يحدث باستمرار، في الصفقات والمشاريع والعمل اليومي، ومعاملته كمهارةٍ تُتعلَّم لا موهبةٍ تملكها أو تفتقرها هو ما يفصل من يبلغون اتفاقاتٍ جيدة باطّراد عمّن يعتمدون على الحظّ أو القوّة.

التحوّل المركزي في فكر التفاوض الحديث من المساومة على المواقف إلى التركيز على المصالح. فحين يفاوض الناس بتثبيت مواقف والطحن نحو تسوية، يبلغون غالبًا صفقةً رديئة أو لا صفقة، لأن المواقف جامدة عدائية. وحين ينظرون بدلًا من ذلك للمصالح الكامنة خلف كل موقف، يجدون كثيرًا أن حلًّا موجودًا يخدم الجانبين أفضل من موقف أيٍّ الافتتاحي، فيحوّلون تنافسًا إلى مشكلةٍ مشتركة تُحلّ.

Interests, Not Positions

The single most important idea in principled negotiation is to focus on interests rather than positions. A position is what someone says they want; an interest is why they want it, and it is at the level of interests that creative agreement becomes possible.

The distinction matters because positions often hide interests that could be satisfied in more than one way. Two people arguing over how to split a sum are taking positions, but if one needs cash now and the other cares about the total over time, an arrangement can satisfy both that neither position revealed. The classic illustration is two people fighting over an orange, splitting it in half, when one wanted the juice and the other the peel, and the whole of each would have satisfied both. Asking why, uncovering the interest behind the position, is what reveals these better solutions.

  • Position: what a party says they want, often a single, rigid demand.
  • Interest: the underlying reason they want it, which can often be met in more than one way.
  • Ask why: uncovering interests behind positions is what opens up creative solutions.
  • Shared and different interests: parties usually share some interests and differ on others, and both create room for a deal.

From focusing on interests flows the practice of inventing options for mutual gain. Rather than treating a negotiation as dividing a fixed pie, where one side's gain is the other's loss, the parties look for ways to expand the pie by trading on their different interests, giving each side more of what it values most. This turns negotiation from a battle into a joint search for value, and it is why the best negotiators spend their energy generating options rather than defending a position.

Note: Behind opposed positions often lie compatible interests. The whole art is to ask why each side wants what it demands, because the answer frequently reveals a solution that serves both better than either opening position.

المصالح لا المواقف

أهمّ فكرةٍ مفردة في التفاوض المبدئي التركيز على المصالح لا المواقف. فالموقف ما يقول أحدٌ إنه يريده؛ والمصلحة لماذا يريده، وعلى مستوى المصالح يصير الاتفاق الخلّاق ممكنًا.

التمييز يهمّ لأن المواقف تُخفي غالبًا مصالح يمكن إرضاؤها بأكثر من طريقة. فشخصان يتجادلان كيف يقسمان مبلغًا يتّخذان مواقف، لكن إن احتاج أحدهما نقدًا الآن واهتمّ الآخر بالإجمالي عبر الزمن، فترتيبٌ يُرضي كليهما لم يكشفه أي موقف. والمثال الكلاسيكي شخصان يتقاتلان على برتقالة، فيقسمانها نصفين، بينما أراد أحدهما العصير والآخر القشر، وكاملُ كلٍّ كان ليُرضي الاثنين. والسؤال «لماذا»، كشف المصلحة خلف الموقف، هو ما يُظهِر هذه الحلول الأفضل.

Know Your Alternative

The most powerful concept in negotiation is knowing your best alternative to a negotiated agreement, sometimes called your BATNA. It is what you will do if this negotiation fails, and it is the true measure against which any proposed deal should be judged.

Your alternative is your source of power in a negotiation. If you have a strong alternative, a good option that does not depend on this deal, you can walk away from a bad offer, which frees you to hold out for a good one. If you have no alternative, you are dependent on reaching agreement, and that weakness shows. The discipline is to know your alternative clearly before you negotiate, and to work on improving it, because the better your alternative, the stronger your position, regardless of how the conversation goes.

  • Know it in advance: understand clearly what you will do if no agreement is reached, before you negotiate.
  • It is your walk-away point: accept a deal only if it is better than your alternative, and reject it if it is worse.
  • Improve it: a stronger alternative gives you more power, so develop it where you can.
  • Consider theirs: understanding the other side's alternative tells you how much they need the deal.

Knowing your alternative protects you from two opposite mistakes: accepting a deal worse than what you could get elsewhere, and rejecting a deal better than your real options out of stubbornness. Judged against a clear alternative, the decision becomes simple, take any agreement better than your alternative, and walk away from any that is worse. This turns the pressure and emotion of negotiation into a clear-headed comparison, which is why the negotiator who best knows their alternative is usually the calmest and the most effective in the room.

Bottom line: negotiation is a learnable skill built on preparation, focusing on interests rather than positions, inventing options for mutual gain, using objective criteria, and above all knowing the alternative that gives you the power to walk away.

أقوى مفهومٍ في التفاوض معرفة بديلك الأفضل لاتفاقٍ متفاوَض عليه، يُسمّى أحيانًا BATNA. وهو ما ستفعله إن فشل هذا التفاوض، وهو المقياس الحقيقي الذي يُحكَم عليه أي صفقةٍ مقترَحة.

بديلك مصدر قوّتك في تفاوض. فإن كان لك بديلٌ قوي، خيارٌ جيد لا يعتمد على هذه الصفقة، تستطيع الانسحاب من عرضٍ سيّئ، ما يحرّرك للصمود لأجل جيد. وإن لم يكن لك بديل، فأنت معتمدٌ على بلوغ الاتفاق، وذلك الضعف يظهر. والانضباط معرفة بديلك بوضوحٍ قبل أن تفاوض، والعمل على تحسينه، لأن كلما قوي بديلك قوي موقفك، بغضّ النظر عن سير الحديث.

معرفة بديلك تحميك من خطأين متعاكسين: قبول صفقةٍ أسوأ مما يمكنك الحصول عليه في مكانٍ آخر، ورفض صفقةٍ أفضل من خياراتك الحقيقية عنادًا. فمقيسًا ضد بديلٍ واضح، يصير القرار بسيطًا، اقبل أي اتفاقٍ أفضل من بديلك، وانسحب من أي أسوأ. وهذا يحوّل ضغط التفاوض وانفعاله إلى مقارنةٍ صافية الذهن، ولذا المفاوِض الأعرف ببديله عادةً الأهدأ والأكثر فاعليةً في الغرفة.
